The following are real and not exaggerated case results. We have worked intelligently and tirelessly to achieve these outcomes for our clients. However, these cases should not be used as an expectation for results in your matter. The following are cases from Humboldt, and the three surrounding counties of Trinity, Del Norte, and Mendocino

People v SR - Law Enforcement sought client for Murder PC 187(a). Through pre-trial representation, convinced DA to file lesser PC 245(a) Assualt with a Deadly Weapon & Force Likely to Cause Great Bodily Injury. After Preliminary Hearing, and before the court ruled on a PC 995 Motion to Dismiss, DA offered a misdemeanor. RESULT: Misdemeanor Battery (PC 242). Probation. No jail.

People v.JG - Felony Possession for Sale Marijuana, Felony Transporation of Marijuana. Client had 471 pounds of marijuana in the back of a U-haul. Judge Granted a Motion for Improper Evidence Handling Excluding 450 pounds of the marijuana from Evidence. RESULT: DEOJ. Case Dismissed and No Conviction After One Year.

People v LF - Hit and Run. Plea Diversion for 25 Hours of CSW. RESULT: Case Dismissed of Successful Diversion; Client Able to Keep his Job.

People v. OG - Felony Possession for Sale Marijuana, Felony Transporation of Marijuana - RESULT: Misdemeanor, No Jail, Forfeit Seized Funds, and Dismissal Against Client's Spouse.

People v CN - DUI. Motion to Suppress for Improper Detention RESULT: Case Dismissed.

People v TM - DUI with Prior. RESULT: Wet Reckelss & Not Guilty on VC 23152(b) - Not License Consequnce. Client Able to Keep his Job Which Required Driving.

In Re: CD (Juvenile) - Forced Rape. Pre-file representtion. RESULT: Case Rejected/Not Filed.

People v MF - Possession of Marijuana with Intent to Sell. Over 50lbs marijuana bud and over $50,000 in cash. Client has strike priors, multiple felony priors, and recent prior prison committments. RESULT: Misdmeanor Possession Over An Ounce. Forfeit Seized Monies. No Jail

People v. DL - Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana, Providing a Place to Use/Store a Controlled Substance. RESULT: Slow Plea. Obey all laws for two years and case will be dismissed. No conviction.

People v. JP - Felony Hit & Run Causing Injury - On Probation for Marijuana Felony. RESULT: Misdemeanor false identification to a police officer. Open Container infraction. Probation. No Jail.

People v. MS - First Degree Burglary, Assault with a Deadly Weapon, Assault with a Stun Gun. Multiple Strike Allegations. RESULT: Deffered Entry of Judgment, Community Service Work, 12 Counseling Sessions. Case to be dismissed in one year. No conviction.

People v JN - Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana, Providing a Place to Use/Store a Controlled Substance. RESULT: Case Dimissed. Out of State Search so Blatently Unsonstitution the Local DA did Not Want to Litigate It. Pending Civil Suit Againt Out of State Law Enforcment.

People v. TL - Felony DUI, Multiple DUIs, and Hit and Run. RESULT: Misdemeanor convictions only. Four days in jail eligible for work alternative program.

People v. MM - Two Felonies Marijuana Cases. 1st: Felony Transportation, Felony Possession with Intent to Sell; 2nd: Felony Cultivation, Felony Possession with Intent to Sell. RESULT: Misdemeanor Simple Possession, Misdemeanor Providing a Place for Storage of Drugs. 50 Hours Community Service Work. No jail.

People v. JO - Arrested for DUI & Felony Possession of Concentrated Cannabis. RESULT: Convinced DA Not to File Charges. Filed Complaint Regarding Officer's Conduct in the Arrest.

People v. CL - Felony Bank Embezzlement, Felony Forgery. Client allegedly took over $21,000 from bank vault and in travelers checks. Mr. Okin subpoenaed records that helped show it could have been any employee that took the money and undermined using experts the writing samples evidence allegedly done by client. Mr. Okin also unveiled gross failure of bank to follow own bank protocols that would show who did take the money. RESULT: Case Dismissed after One Year Diversion. No Conviction.

People v. CB – Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana. Large Indoor Marijuana Grow. RESULT: Jury Trial. Not Guilty on All Charges.

People v. JM – Felony Marijuana Cultivation and Violation of Probation. RESULT: Jury Trial. Not Guilty and Probation Not Violated.

People v. AA - Minor in Possession of Alcohol, Petty Theft. Under-aged college student stole a bottle of vodka from a local store. RESULT: Case dismissed after client completed 25 hours of Community Service Work.

People v. DS - Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana. Client was accused of being involved in a large commercial grow. Mr. Okin was able to show that although he was located on the property where it occurred, he was not involved. RESULT: Case Dismissed.

People v. RM - Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana Felony Possession of Concentrated Cannabis. Client maintained a large grow at a rental house in a ring of grow houses. RESULT: Reduced to Misdemeanor and Expunged After 18 Months Probation.

People v. CB – Four Counts Murder (PC 187), Four Counts Vehicular Manslaughter With Gross Negligence, Four Counts Vehicular Manslaughter, Five Counts Felony DUI, Four Great Bodily Injury Counts, Driving on a Suspended License, High Blood Enhancement (.21). Prior DUI and Felony Evading Arrest. Judge threw out an earlier plea bargain reached with another Private Attorney as being too lenient. Mr Okin retained. New offer from District Attorney of 16 years, 8 Months rejected. RESULT: Jury Trial. Jury Agreed on All Counts with Mr. Okin. Not Guilty on All Four Counts of Murder. Not Guilty on All Four Counts of Four Counts Vehicular Manslaughter With Gross Negligence. Client convicted of Four Counts Vehicular Manslaughter and One Court of DUI with Injury. Client was sentenced to 9 years, 8 months. Mr. Okin appealed that sentence as improper and Appellate Court agreed and the sentence reduced to 6 year 8 months. Time served in Fire Camp at one-third time before being released.

People v EM: DUI. Necessity Defense. RESULT: Jury Trial. Not Guilty.

People v CS – Resisting Arrest, Battery on Hospital Personnel, Drunk in Public.RESULT: Jury Trial. Not Guilty All Counts.

People v. RK – DUI. Not Driving Defense. RESULT: Jury Trial. Not Guilty.

People v. SS. – Felony Child Endangerment, Felony Great Bodily Injury Strike Allegation. A six month old infant suffered 1st and 2nd degree burns on 30% of his body. Prosecution experts testified the nature and cause of the burns were purposeful. Mr. Okin located and used a renowned burn expert from Oakland Children's Hospital. RESULT: Jury Trial. Deadlocked Jury voting 10-2 in favoring acquittal. Case Dismissed by Prosecutor Before Re-trial.

People v. KS. – Felony Child Endangerment. Case Diverted for in patient alcohol treatment. Diversion completed by client. RESULT: Case Dismissed.

People v. JF – Unlawful wasting of game meat. RESULT: Jury Trial. Not Guilty

People v. DM. – DUI. Officer claimed client rolled through a stop sign and peeled out. Subsequently arrested for a DUI. Motion filed claiming client's 4th Amendment Rights Violated by Arcata Police Officer.RESULT: Motion to Suppress Granted. Case Dismissed.

People v. CB – DUI – Commercial License at Stake. .15 Blood Test. RESULT: Jury Trial. Dismissed after Jury Deadlocked.

People v. CH – Possession of Methamphetamine with Intent to Sell, Two Prior Convictions for Sales of Methamphetamine (which led to state prison commitments). Presumed probation ineligible. RESULT: Felony Simple Possession. Probation. No Actual Jail Time.

People v. XX – Carrying a loaded concealed weapon in car. Motion filed claiming client's 4th Amendment Rights Violated by Fish and Game Officer. RESULT: Motion to Suppress Granted. Case Dismissed.

In Re Minor (Juvenile Court) – Forced Sexual Battery. RESULT: Court Trial. Not Guilty.

In Re Minor (Juvenile Court) – Felony Vandalism. Over $12,000 alleged damage to local school. RESULT: Reduced to Misdemeanor.

In Re: Minor (Juvenile Court) – DUI. RESULT: Pre-trial Diversion.

People v. JS - Possession of Stolen Property. Motion to Dismiss for Due Process violation granted for failing to properly bring the defendant to court in a timely manner. RESULT: Motion Granted. Case Dismissed.

People v JS - Felony Manufacturing Controlled Substance, Felony Possession of Controlled Substance. RESULT: Misdemeanor Simple Possession Diverted for Drug Treatment. After Treatment Completed. Case Dismissed. No Conviction on Record.

People v. RB – Possession of Marijuana for Sale, Unlawful Cultivation of Marijuana, Possession of Illegal Assault Weapon. Large scale commercial marijuana grow operation, over 30k in cash and 10k in other assets seized. Motion to Traverse and Quash Warrant Filed (with Motion to Suppress evidence) claiming Arcata Police Officer violated client's 4th Amendment Rights. RESULT: Motion to Suppress Granted. Reduced to Misdemeanor Simple Possession before Balance of Motions Litigated. $10,000 in Assets Returned to Client. No Jail.

People v. BB – Manslaughter, Negligent Discharge of a Firearm, Felon in Possession of an Illegal Assault Weapon, Multiple Assault with a Deadly Weapon Charges. Defendant presumed probation ineligible was for prior felonies and prison commitments. RESULT: Manslaughter with Balance of Charges Dismissed. Probation. No Additional Jail.

People v. SB – 1st Degree Burglary, 1st Degree Home Invasion Robbery. Two co-defendants took felony strike plea bargain for probation if they agreed to testify against client and he was the focus of the investigation. RESULT: Misdemeanor possession of stolen property (After aggressive defense investigation and motions filed).

People v. JR – Felony DUI with Injuries to Multiple Persons w/ Prior DUI, High Blood Enhancements (over a .23) and Prior Conviction for Assault with a Deadly Weapon. RESULT: Reduced to Misdemeanor. Residential Treatment. No Additional Jail Time.

People v. JM – Felony Child Endangerment, Felony Great Bodily Injury Strike Enhancement, Possession of Illegal Fireworks. RESULT: Reduced to Misdemeanor. Future Employment Saved. Community Service Work. No Jail.

People v. JC – Multiple DUI Cases, Each with High Blood Alcohol Enhancements. RESULT: Plea bargain to one first time DUI. No Jail. Client's company saved.

People v. CM – Felony Evading Arrest, and Felony Child Endangerment, DUI w/ 2 priors. Prior evading and child endangerment cases. RESULT: Felony Evading with Reduction to Misdemeanor after Probation. 200 Community Service Work. No Jail. DMV suspension lifted and drivers licensed returned after successful Administrative Appeal granted.

People v. CW – DUI w/Prior, Hit and Run. – RESULT: Case reduced to Wet Reckless. DMV Hearing in favor of client.

People v. SJ - Marijuana DUI – RESULT: Pre-Charging Meeting with DA. Case Not Filed.

People v. LK – Felony Car Theft – RESULT: Case Dismissed at First Court Hearing so client could get mental health treatment

People v. ZD – Felony Transportation of Marijuana. Seized package of marijuana at airport. RESULT: Motion for Improper Venue Granted. Case Dismissed.

People v. LW – Felony Burglary, Felony Vandalism. Defendant plead guilty to Felony Vandalism with Public Defender. Mr. Okin retained. RESULT: Motion to Withdraw/Undo Felony Plea Granted. Reduced misdemeanor vandalism. No additional Jail.

People v. JB – DUI – RESULT: Dry Reckless. Fine Only. No Probation. No Jail.

People v. AH – Resisting Arrest, Drunk in public. RESULT: Infraction (fine only).

People v. OR – Assault with Deadly Weapon, Felony Strike Offense. RESULT: Reduced to Misdemeanor. No Jail. Counseling services.

People v. JP –Multiple Felony Strike Arson Charges. RESULT: Reduced to Misdemeanor. Counseling. No Jail.

People v. SR – Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana. Multiple grow operations including building with in excess of 750 plants and another with 50 plants. RESULT: Jury Trial. Not Guilty on All Counts.

People v. YT – Carrying Concealed Weapon. RESULT: Motion to Suppress Granted. Case Dismissed.

People v. PL– Felony Possession of Drugs. RESULT: Motion to Suppress Granted. Case Dismissed.

People v. ST - .15 DUI – Mr. Okin discovered officer did not follow proper protocol. RESULT: Wet Reckless. Jail Avoided.

People v. MR. – Felony Transportation of Psilocybin Mushrooms, Felony Possession of Psilocybin Mushrooms. RESULT: Misdemeanor Possession. No Jail.

People v. PF – Force Rape of Stranger. RESULT: Misdemeanor Simple Battery. No Additional Jail

People v. JP – Felony Force Rape, Felony Forced Oral Copulation, Felony False Imprisonment, Felony Spousal Battery. Prior convictions for Felony Spousal Abuse. RESULT: Felony Spousal Battery. No Additional Jail.

People v. PS – Multiple Counts of Child Molestation. Evidence of prior incidents with other children. RESULT: Statutory Rape with Guaranteed Probation. Avoided Lifetime Registration as Sex Offender. Case to be Reduced to Misdemeanor at End to Probation.

People v. JD – Felony Driving Under the Influence w/ 3 priors. RESULT: Probation. At Sentencing, Mr. Okin Convinced Judge to Reduce the Conviction to a Misdemeanor. Client Maintained Employment at Pelican Bay State Prison.

People v. JGB – Possession of Marijuana for Sale, Possession of Concentrated Cannabis, Unlawful Cultivation of Marijuana, Possession of Illegal Assault Weapon, Weapons Possession Enhancement. Over 10lbs of pounds of concentrated cannabis, processed marijuana, multiple firearm (including an illegal banned assault weapon). RESULT: Misdemeanor Accessory to a Crime. No Additional Jail.

People v. KSC – Possession of Marijuana for Sale, Unlawful Cultivation of Marijuana. Co-defendant case in which over 100lbs processes marijuana, weapons, over $150,000 in cash. RESULT: Case Dismissed.

People v. CS – Felony Possession of Marijuana for Sale, Felony Unlawful Cultivation of Marijuana. Defendant converted entire rental house to illegal grow. RESULT: Reducible Felony Probation. Case Reduced to Misdemeanor after 18 months.

People v. DC – THREE SEPARATE FELONY CASES involving Possession of Marijuana for Sale, Unlawful Cultivation of Marijuana, Possession of Peyote. RESULT: Misdemeanor Possession.

People v. CW – Felony Statutory Rape (Multiple Counts). RESULT: Reduced to Misdemeanors. Counseling. Lifetime Sex Registration Avoided. No Jail.

People v. JK – Assault With a Deadly Weapon, Robbery in Concert with Other (Multiple Strikes Alleged). RESULT: Jury Trial. Client Found Not Guilty on All Felonies. Client Convicted on Lesser Offense of Misdemeanor Petty Theft.

People v. HO – Felony Possession of Methamphetamine. Defendant plead to felony possession of methamphetamine with another local private attorney. Mr. Okin then retained. Motion to Withdraw/Undo Felony Plea Granted. RESULT: Misdemeanor simple possession of methamphetamines. Felony Conviction Undone and Avoided. No Jail.

People v. TF – Over Twenty-Four Felony Counts. Burglary, Passing Falsified Prescriptions, Possession of Narcotics with Intent to Distribute, Possession Controlled Substances. RESULT: Felony Probation. All Charges to be Reduced to Misdemeanors at the End of Probation and Expunged from Client's Record. No Actual Jail (Electronic Home Monitoring).

People v. SS – Possession of Marijuana for Sale, Unlawful Cultivation of Marijuana. Medium size marijuana grow operation, over 10k cash seized. RESULT: Misdemeanor. Seized 10K cash returned to client.

People v. MB. – Possession of Marijuana for Sale, Unlawful Cultivation of Marijuana. Large commercial marijuana production in hidden underground rooms, over $15k seized. RESULT: Case Dismissed. Seized 15K Returned to Client.

People v. BW. – Vehicular Manslaughter. RESULT: Community Service Work. No Jail.

People v. FH – Elder Abuse. Mr. Okin found able to discover records that the claimed injures were suffered in a fall not related to client's actions. RESULT: Case Dismissed.

People v ER – Embezzlement. Client gave oral and signed confession. Confession challenged as illegal and coerced. RESULT: Case Dismissed.

People v. TJ – Unlawful Camping - Homeless person arrested from sleeping in tree area because shelters were full. RESULT: Court Trial. Not Guilty

People v. DS – DUI. Motion filed claiming client's 4th Amendment Rights Violated by Fortuna Police Officer. RESULT: Motion to Suppress granted. Case Dismissed.

People v. CH – DUI w/ Prior Convictions. Motion filed claiming client's 4th Amendment Rights Violated by Fortuna Police Officer. RESULT: DA Offered Plea Bargain to Avoid Litigation of Defense Motion. Wet Reckless. No Jail.

People v SR – DUI. Motion filed claiming client's 4th Amendment Rights Violated by Eureka Police Officer. RESULT: Dry Reckless. No Jail. (DA made Offer to Avoid Litigation of Defense Motion).

People v. ML – (Federal Court) Over five pounds processed marijuana on Federal Property. RESULT: Reduced to Class B Misdemeanor. Fine only. No Probation. No Jail.

People v. RK - Felony Possession Marijuana for Sale, Felony Cultivation, Child Endangerment. Over 100 pounds processed marijuana and close to $95,000 dollars and $35,000 in Jewelry Seized. RESULT: MisdmeanorFelony Wobbler for Probation and Community Service Work. Charge can later be reduced to a misdemeanor. Assets Forfeited.

People v. SJ – Attempted Homicide, Felony Assault with a Deadly Weapon (Handgun), Felon in Possession of a Firearm, Robbery, Drug Possession. Client facing Life in Prison. RESULT: Misdemeanor Simple Drug Possession.

People v. TC – Felon in Possession of a Firearm. Presumed Probation Ineligible because of Prior Record. RESULT: Felony Probation with Reduction to Misdemeanor at End of Probation. Community Service Work. No Jail.

People v. DD – Possession of Marijuana with Intent to Sell, Felony Cultivation of Marijuana. Medium grow with indicia of sales related activity. RESULT: Misdemeanor Simple Possession. No Jail.

People v. DH – Felony Spousal Abuse, Felon in Possession of Firearm. Prior Felony alleged for Discharge of a Firearm into an inhabited dwelling. RESULT: Infraction Disturbing the Peace. Fine Only. No Probation. No Jail.

People v. RDL – Felony Assault Causing Great Bodily Injury (Strike Offense). Two Prior Strikes alleged. Client Facing Life in Prison. 1st RESULT: Penal Code 995 Motion to Dismiss Granted. Case Dismissed. Prosecutor Re-filed the case. 2nd RESULT: Motion to Dismiss on Due Process Grounds Granted. Case Dismissed a Second Time. No Attempted Re-Filing.

People v. DF - Hit and Run - RESULT: Case Dismissed.

People v. TW - Felony Sexual Assault, Felony Possession Marijuana for Sale, Felony Unlawful Cultivation of Marijuana, Three Open DUI Cases with Priors, Driving on a Suspended License with Priors, 3 Probation Violations (10 Cases in All). RESULT: Misdemeanor False Imprisonment, Marijuana Charges Dismissed, Two New DUIs, One Wet Reckless, Admit VOPs. 145 Days Custody - SWAP Eligible Instead of Serving Time in Jail. Client Avoids Registration as a Sex Offender.

People v. BS - Felony Transportation of Marijuana. Client possessed a relatively small amount of marijuana in his vehicle without a physician recommendation. RESULT: Simple Misdemeanor Possession. No jail.

People v CL- Felony Transportation of Heroin, Felony Possession for Sale Heroin. Defendant on two grants of felony probation. RESULT: Felony Simple Possession of Hermon. Credit for Time Served. No Jail.

People v RD - Felony Criminal Threats (Strike), Misdemeanor Spousal Battery. Client on two grant of felony probation including Assault with a Deadly Weapon. Probation recommended prison for a third time. RESULT: Misdemeanor Spousal Battery, Reinstatement on Probation. Credit for Time Served. No Jail.

People v SF - Misdemeanor Vandalism, Petty Theft. RESULT: DA Diversion. Case Dismissed.

People v. AZ - Felony Possession for Sale Marijuana, Felony Possession MDMA, Possession Steroids, Possession of Firearm in the Commission of a Felony. RESULT: Misdemeanor Marijuana and Misdemeanor Possession MDMA. No Jail.

People v. PW - Felony Possession Marijuana for Sale, Felony Cultivation, Manufacturing Concentrated Cannabis. Over 200 pounds processed marijuana and $150,000 dollars. RESULT: Felony Wobbler for Probation and Community Service Work. Charge can later be reduced to a misdemeanor. Assets Forfeited.

People v. DC - Driving Under the Influence, Refusal, Driving without a Valid License. Case taken over from Public Defender with standing offer of DUI and dismiss the Refusal and Driving Without a Valid License. RESULT: Dry Reckless. No Jail.

People v. KO - Felony Possession of Ecstasy, Felony Possession of Concentrated Cannabis. RESULT: 30 day Deffered Entry of Judgment with 50 hours of Community Service Work. Case Dismissed. No Conviction.

People v. AS - Felony Possession of Marijuana with Intent to Sell, Felony Distribution of Marijuana. Defendant caught in hand to hand sale to undercover law enforcement officer. RESULT: Misdemeanor Distribution of Marijuana. No jail.

People v. BS - Felony Child Abuse. Prior Felony Assault Conviction. RESULT: Case Dismissed.

People v. CA - Marijuana DUI. RESULT: Stop Sign & Speeding & Seat Belt Ticket

People v. LB - Possession of Negotiable Instruments (50k Cash). RESULT: Case Dismissed.

People v. TG - Felony Vandalism, Drunk in Public. RESULT: Case Dismissed.
